Treaty of Culoria on TEPwiki

The Treaty of Culoria (Packilvanian: luKhavnan aKuloriya) is a legally binding treaty between Packilvania and the Union of Commonwealth Alliances. The treaty followed the withdrawal of Axdel and the UCA from the Puntalia Compromise Treaty of 2020. The agreement was agreed in September 2022. Background

In 2020, Rodenia invaded Puntalia. The UCA and Axdel intervened on the side of Puntalia and Packilvania supported Rodenia. The so-called 2020 Puntalia Military Intervention eventually ended with a treaty known as the Puntalian Compromise Treaty. This resulted in the creation of New Puntalia. Puntalia was supposed to be granted independence but was de facto under Rodenian military occupation. New Puntalia was recognised as the successor state of Puntalia and took up its seat in the UCA. The UCA and Axdel remained bitter and disgruntled about the arrangement. In the beginning of 2022, Axdel withdrew from the treaty and sent a naval force outside Rodenian waters to enforce a de facto blockade. The UCA in turn unilaterally left the treaty as well. Drakkengard petitioned the International Forum to condemn the UCA and Axdel for violating international law. Despite heated debate and passionate representations about international law and the UCA and Axdel's failure to negotiate a peaceful settlement, the International Forum broadly decline to condemn the UCA and Axdel.

Packilvania attempted to defend Rodenia and often portrayed its fight for Rodenia in positive terms in Packilvanian media. Behind closed doors, the Council of Ministers of Packilvania was divided on the conflict and since taking over as Regent from Sultan of Packilvania Namdun III, Prince Thumim wanted to take Packilvania in a new direction diplomatically. Leaked memos show that Prince Alawadun secretly approached Alksearia to begin crafting a negotiated settlement to the conflict. After months of threats and posturing, a first draft emerged.

Negotiations

The Agreement was drafted by Packilvania and brought to the floor for debate by the UC Council member for Alksearia in August 2022. At first, Packillvania proposed that Great Morstaybishlia should act as the mediator and arbitrator for future disputes arising from the agreement. Several member states, most notably Norgsveldet protested that Morstaybishlia was not a neutral actor and wopuld be prejudiced to side with Packilvania in any future disputes. Alksearia felt that Morstaybishlia had the weight and influence to ensure compliance with the treaty from Packilvania. Similar sentiments were shared by other member states. Some member states suggested that the International Forum should act as an arbitrator but Packilvania refused on the basis that the IF and its Security Council would be biased towards the UCA. Other candidates were proposed such as Nystatiszna (which was ruled out because it was too weak, small and dealing with an ongoing war on its doorstep), Tretrid (it was not seen as adequately neutral as it was an observer state of the UCA) and Asendavia (which some member states did not have positive relations with that nation). In the end they settled on Oscrelia being the arbitrator as it was typically neutral in international affairs.

The second area of contention was the fact that Packilvania wanted trade sanctions to be removed. A legal argument was presented that because the UCA did not coordinate trade policy as a bloc, it would not be viable to implement a trade mandate over the whole organisation. Although the North Concordian Economic Forum arguably had such capabilities, given that not all UCA member states were NCEF members, it was not possible. Other countries especially felt that this would be akin to the UCA dictating trade policy. Durakia, especially, outlined their refusal to sign onto any agreement which set a precedent for Packilvania or the UCA to dictate any weakening of their trade restrictions with external powers, echoing the nation's historic affiliation with an economically-patriotic skepticism towards free trade. As such, Packilvania presented a parallel agreement called the Pax-UCA Trade Partnership which willing member states could sign on to. Although targeted at the entire UCA, political analysts believed that it was especially desirable for the NCEF member states especially Norgsveldet Imperial Realms to participate as they represented a lucrative market for Packilvania as well as Alksearia because they are among the states seen as critical for securing Packilvanian trade beyond the Concordian Ocean (see the Gateway States policy section in Foreign relations of Packilvania for more details).

Another area of contention was the section on the referendum. Originally Packilvania wanted Puntalia to have the option of either joining New Puntalia, being an independent state or joining Rodenia. The UCA member states were vehemently against the latter option and it was removed from the original agreement.

Articles

Article 1

Article 1 forms what was essentially a non-aggression pact between the UCA and Packilvania, with both sides pledging not to engage in military hostilities, help another power invade the other, or to support those who would try to destabilize the signatories.

Article 2

Article 2 provides a framework for cooperation regarding Puntalia in the aftermath of the demise of the Puntalian Compromise Treaty, with the two sides agreeing to force Rodenia to withdraw its military presence from Puntalia, to hold a referendum for the future status of Puntalia, and to keep the peace between Rodenia, Puntalia, and New Puntalia.

Packilvania agreed to not interfere with Puntalia and New Puntalia, while the UCA agreed to not interfere with Rodenia.

Article 3

Article 3 designates Oscrelia as a neutral arbiter for future disputes regarding the treaty. Both Packilvania and the UCA are forbidden from withdrawing from the treaty without first seeking dispute resolution through a tribunal overseen by the Oscrelian government that would determine if the treaty's provisions had been broken.

Article 4

Article 4 names the Oscrelian government the depositary and mandates that it distribute copies of the treaty to Packilvania and all of the UCA member states.
